New Bristol Business

Subject: New Bristol Business

Hello DECD,

I am looking to bring a series of magic machine booths to Bristol, CT. The name of my business is "HAIR FOR NOW! VIAGRA FOR LATER" These magic machine booths will be placed in specifically targeted areas and will focus on those headed out on a date or special occasion.

Imagine for a second that you are bald. Or perhaps you know a loved one who suffers from baldness. Millions of Americans are bald. In addition, no bald Presidents have been elected in over 50 years (although I am hoping that Vin Diesel runs for President. He's a great actor just like Reagan). There is a stigma about being bald. That is where my magic machine booths come into play. On your way to your date, you hop into one of my booths. A large full-length photo of Tiffani Amber Thiessen (Saved by the Bell version, not the bad girl 90210 vixen version) drops down. She asks what color hair you want, for example, brown. You then pay with your credit card, Tiffani goes back up, and a brown wig appears. It is both a magic trick and a vending machine. A magic machine! Then, Tiffani will drop down again and ask if you need any Viagra. Talking to Tiffani, you should be able to tell if you will need any or not. If you do, simply insert your credit card, Tiffani will wish you luck and goes back up, and a Viagra will appear. More magic from this machine!

I believe this is a great business opportunity for me as well as the city of Bristol. My demographic research has responded well to Bristol as well as Tiffani. I plan to start out small with only 150 magic machine booths, but hope to expand to well over 7,000 within 5 years. I would like to act as quickly as possible before my largest competitor, "60 Second Hair and a 5 Hour Erection", moves in. Please let me know what I will need to do to begin business and any permits I will need. I want to make it clear that two people will not fit into one of these booths. It is strictly an intimate solo encounter with Tiffani.

Thank you in advance and I look forward to hearing from you,
Sasha Kaun

subjectCT SMALL BUSINESS DEVELOPMENT CENTER (SBDC)-SASHA KAUN: New Bristol Business

Dear Sasha:

I am attaching a link to the Small Business Development Center website where you can request free business counseling with the CT SBDC.

This is required as a part of our official client intake process.

1. Please go to our website and fill in an electronic request for counseling – here is how:

· Go to www.ctsbdc.org

· Click on Offices and staff tab on top

· Choose your town from the drop down menu under the map on the right

· Click Go

· Click on the orange rectangle 'Workshops and Online Request for counseling'

· On the next screen, click on 'Online Request for counseling' again (next to the Check mark)

· Enter your email address and start filling in the request - some information (all confidential) about your company and select the areas you need assistance in.

· Once the request is filled and sent in the system, we will see it and a counselor assigned to your region will contact you.

2. Are you working with a business attorney? I caution you in how you proceed with your idea. There may be some copyright infringement issues associated with using a picture of a celebrity without permission or using the photograph for “exploitative purposes” (see internet links below):

http://www.citmedialaw.org/legal-guide/using-name-or-likeness-another

(copy & paste into your internet browser)

Using the Name or Likeness of Another

In most states, you can be sued for using someone else's name, likeness, or other personal attributes without permission for an exploitative purpose. Usually, people run into trouble in this area when they use someone's name or photograph in a commercial setting, such as in advertising or other promotional activities. But, some states also prohibit use of another person's identity for the user's own personal benefit, whether or not the purpose is strictly commercial. There are two distinct legal claims that potentially apply to these kinds of unauthorized uses: (1) invasion of privacy through misappropriation of name or likeness ("misappropriation"); and (2) violation of the right of publicity. (The "right of publicity" is the right of a person to control and make money from the commercial use of his or her identity.)

3. Making Photos of People

3.1 What should you bear in mind when photographing people?

There is no general legal requirement to obtain someone’s authorization to take his or her photograph. However, there are situations where photography can infringe on important social interests such as national security, protection of children, right of privacy, etc. Most of these situations are strictly controlled by national laws and regulations. Irrespective of the legalities, there are also some things a photographer should not photograph for ethical reasons. Certain photographs of people may amount to exploiting the persons concerned or misrepresenting the truth. If you, as a photographer, know the law and one’s legal rights, you will also be in a better position to find solutions that minimize your legal risks.

Often, you may be free to take a photograph of a person, but the way the image is used may give the person shown in the photograph a right to take legal action.

If you have questions, please feel free to contact me at 860-270-8178.

Yours truly,

Hello Andrea,

Ms. Dobson stated I might be infringing on Tiffani's likeness; however, I have not heard from her regarding my follow-up questions. It was stated I may be infringing on Tiffani's rights by using her picture. Therefore, I will not use her picture. Instead I will use a picture of a girl that looks similar, but has much bigger breasts, thus a different person. Also, instead of a tight Bayside High t-shirt, she will be wearing a Valley High t-shirt. Tiffani would never wear a Valley shirt so this should alleviate the Tiffani likeness problem. Let me know if you still think it will be a problem.

Also, I am thinking of adding music to my booths. Is there any restriction toward music being played or permits I would need. I would prefer to use the 06010 theme-song.

Again, thank you for you assistance. It is refreshing to have someone help that is so knowledgable on all the permits and requirements. Do you think I am aiming too low with only 150 magic machine booths? Again, I would like to move a quickly as possible to enter the market before my main competitor "60 Second Hair and a 5 hour erection" enters the market.

I look forward to hearing from you,
Sasha Kaun

Andrea,

Were you able to reach out to Rosita? I have not heard back from her. Is she alright? I would let her have a complimentary visit to one of my magic machines, but she doesn't seem like the target demographic. Perhaps a fruit basket instead?

Please let me know as soon as possible.

Have a good day,
Sasha
